Welcome to Sitestinger. These Terms of Service (“Terms”) govern your use of sitestinger.com (the “Site”). By accessing or using the Site, you agree to these Terms. If you don’t agree, please don’t use the Site.
1. About Sitestinger
Sitestinger is a Google Accredited bilingual (English & Spanish) website-design and digital-growth studio that builds premium, SEO-optimized websites for small businesses, real-estate professionals, and ambitious brands worldwide. The Site is our marketing presence and the place to begin a conversation with us.
2. Scope of these Terms
These Terms cover your use of the public Site only — browsing pages, reading content, and submitting the contact form. Any paid engagement (custom website design, SEO work, Google Business Profile setup, social-media account creation, ongoing maintenance, etc.) is governed by a separate written engagement agreement signed by both parties. If there is a conflict between these Terms and your engagement agreement, the engagement agreement controls.
3. Using the Site
You agree to use the Site in good faith. Specifically, you agree not to:
- Use the Site for any unlawful, fraudulent, or harmful purpose;
- Attempt to gain unauthorized access to the Site, its servers, or any related systems;
- Interfere with the Site’s normal operation (e.g. denial-of-service attacks, scraping at abusive rates, bypassing rate limits or anti-bot measures);
- Submit false, misleading, or impersonating information through the contact form;
- Reverse-engineer, decompile, or attempt to extract source code, except where applicable law expressly permits it;
- Use any automated tool (bot, scraper, crawler) to collect data from the Site beyond what is allowed by our
robots.txt; - Upload or transmit any virus, malware, or harmful code.
We reserve the right to block or restrict access to anyone who violates these Terms.
4. Intellectual property
All content on the Site — including the Sitestinger name, logo (the bee-on-laptop mark), wordmark, copy, design, layout, typography, graphics, photography, illustrations, and code — is owned by Sitestinger or its licensors and is protected by copyright, trademark, and other intellectual-property laws.
You may:
- View, share, and link to public pages of the Site for non-commercial reference;
- Quote short excerpts of our written content with clear attribution.
You may not, without our prior written permission:
- Copy, reproduce, republish, or redistribute substantial portions of the Site;
- Use the Sitestinger name, logo, or other trademarks for your own commercial purposes or in a way that suggests endorsement or affiliation;
- Use Site content to train machine-learning or generative-AI models.
5. Client testimonials and case examples
Testimonials and case examples shown on the Site are real and are used with the subject’s permission. Past performance does not guarantee future results for any particular project.
6. Submissions and feedback
If you submit ideas, suggestions, feedback, or other information to us through the contact form or otherwise (collectively, “Submissions”), you grant Sitestinger a non-exclusive, royalty-free, worldwide license to use those Submissions to operate, improve, and promote our services. Submissions are not confidential. Please don’t send us information you consider sensitive, proprietary, or trade secret through the public contact form — reach out first and we’ll set up a private channel.
7. Third-party links and services
The Site links to third-party services such as our Instagram profile, Google services, and may reference partners or tools. We don’t control those services and are not responsible for their content or practices. Your use of any third-party service is governed by that provider’s terms and privacy policy.
8. Free consultation and audit
We offer a free initial consultation and a free audit of your current online presence. The free consultation does not create an obligation on either side. We reply to qualified inquiries within 1–3 business days. We reserve the right to decline projects that fall outside our focus or capacity.
9. Disclaimers
The Site and the information on it are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do our best to keep the Site accurate and operational, but we don’t guarantee that it will be uninterrupted, error-free, free of viruses, or current at every moment.
Nothing on the Site constitutes professional, legal, or financial advice. Marketing claims about typical timelines, results, or rankings are illustrative; actual outcomes depend on your specific project and market.
10. Limitation of liability
To the maximum extent permitted by law, Sitestinger and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of the Site — even if we’ve been advised of the possibility of such damages.
Our total aggregate liability arising from or relating to the Site will not exceed one hundred U.S. dollars (US $100) or the amount you paid us for use of the Site (if any), whichever is greater.
Some jurisdictions don’t allow the exclusion or limitation of certain warranties or liabilities, so portions of this section may not apply to you.
11. Indemnification
You agree to indemnify and hold Sitestinger harmless from any claim, liability, loss, or expense (including reasonable attorneys’ fees) arising out of your violation of these Terms, your misuse of the Site, or your violation of any third-party right.
12. Privacy
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
13. Changes to the Site and to these Terms
We may modify or discontinue parts of the Site at any time. We may also update these Terms from time to time. When we do, we’ll update the “Effective” date at the top. Material changes will be clearly flagged. Your continued use of the Site after changes take effect means you accept the updated Terms.
14. Governing law and disputes
These Terms are governed by the laws of the United States and the State of Texas, without regard to conflict-of-laws principles. You and Sitestinger agree to attempt to resolve any dispute informally first by emailing gbs@sitestinger.com. If we can’t resolve it within 30 days, either party may bring an action in the state or federal courts located in Texas, and you and Sitestinger consent to the personal jurisdiction of those courts.
15. Miscellaneous
- Entire agreement. These Terms (together with our Privacy Policy and, where applicable, your signed engagement agreement) form the entire agreement between you and Sitestinger regarding the Site.
- Severability. If any part of these Terms is held unenforceable, the rest will remain in full force and effect.
- No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
- Assignment. You may not assign these Terms without our written consent. We may assign them to a successor in the event of a merger, acquisition, or restructuring.
